Case Description

On May 10, 1993, Complainant Chandler Glover filed an individual charge of discrimination against his employer, the United States Postal Service (hereinafter the "USPS" or "Agency"). On October 1, 1998, Complainant Chandler Glover amended his charge of discrimination, claiming that permanent rehabilitation employees, as a class, suffered employment discrimination. Specifically, Complainant Glover alleged that he and other permanent rehabilitation employees were denied promotional opportunities and opportunities to advance their careers with the USPS, as a result of their alleged disabilities.

The USPS denied the allegations asserted by Complainant Glover and filed several challenges in opposition to Complainant Glover's Class Complaint. Notwithstanding, on March 30, 2000, a United States Equal Employment Opportunity Commission ("Commission") Administrative Judge entered an Order certifying Complainant Glover's case as a class action. The Administrative Judge's decision to certify this matter as a Class Complaint was affirmed, over the USPS?s objections and request for reconsideration, by the Commission's Office of Federal Operations ("OFO") on August 16, 2001.

On December 18, 2001, the Administrative Judge entered an Order granting co-class agent Glover's request to add Dean Albrecht as an additional co-class agent. As such, this case is currently captioned as Chandler Glover and Dean Albrecht, et al. v. John E. Potter, Post Master General, EEOC No. 320-A2-8011X; Agency No. CC-801-0015-99.

The Commission has defined the class in this matter to include:

Those persons employed by the USPS throughout the United States between January 1, 1992, and the present while in permanent rehabilitation positions who were allegedly denied promotional and/or advancement opportunities allegedly due to discrimination on the basis of disability.

The Parties have now agreed, as more fully set forth in the Settlement Agreement.
